1. Terms and Conditions
Tetra Insights, Inc. (“Tetra Insights”), is a data and research company. Research participants and survey respondents (“you” or “participant”) may interact with Tetra Insights through tetrainsights.com or through the ParticipantHQ website at participanthq.com,, which may be conducted by teleconferencing and other methods (collectively, “Research” or “Research Project”). By participating in Tetra Insights Research, you may have the opportunity to influence the development and marketing of products and services. You may receive an invitation to participate Tetra Insights Research, and if eligible, may participate in Research in the form of online surveys and interviews conducted on behalf of Tetra Insights or our clients. You may receive incentives for participating in our Research as outlined herein below. By participating in a Research Project, you agree to these terms (“Terms and Conditions”). These Terms and Conditions constitute the entire agreement between you and Tetra Insights with respect to your participation in Tetra Insights Research.
2. Eligibility
Participation in Tetra Insights Research is limited to individuals who are not prohibited from participating under any applicable law, including laws of the United States and the laws of the jurisdiction in which the individual resides. Participants must be at least 18 years of age or older at time of participation. Employees and directors of Tetra Insights and its affiliates are ineligible to participate. Employees of Tetra Insights and its affiliates may register as members solely to refer friends to Tetra Insights, but may not refer other employees of Tetra Insights or employees of affiliates. By participating in a Research Project, you agree to be bound by all eligibility determinations made by Tetra Insights in accordance with each Research Project’s particular specifications, applicable codes of ethics, applicable laws, and these Terms and Conditions. All eligibility determinations shall be made by Tetra Insights in its sole discretion, and such decisions are final and binding. Only U.S. residents are eligible for incentives unless otherwise stated. Answers you provide to Tetra Insights in Research must be consistent, truthful, and reliable. For Research Projects targeting business professionals, participants must be able to provide confirmation they are actively employed or working in the role described as the focus of the particular Research Project.
3. Registration and Participation
By participating in a Research Project, you are registering as a participant. Registration requires that you receive occasional emails pertaining to the Research that you are participating in.
As part of the Research, you will be asked to provide certain information and feedback about your experience, including general and specific feedback, answers, suggestions, observations, ideas, and similar information (“Feedback”). As part of the Research, Tetra Insights may capture or record your name, image, likeness, performance, voice, personal characteristics, statements, testimonials, activities, other indicia or biographical information (collectively, “Likeness”), whether in the form of audio, video, photography, or another medium (“Recording”).
All Feedback and Recordings will be owned exclusively by Tetra Insights. You agree that Tetra Insights and its clients may use your Feedback and Recordings for any lawful purpose whatsoever, including without limitation research, development, and commercialization of technology, products, and services, without any further obligation to you of any kind other than the incentive that may be applicable to the particular Research Project, if applicable.
You hereby grant Tetra Insights all right, title and interest in and to the Feedback and the Records, including without limitation, any copyright (including moral rights), and waive any and all rights and claims of any kind that you may have with respect to the Feedback and the Recordings, and Tetra Insights’ and its clients’ use of the same. You further grant to Tetra Insights and its clients permission to use, edit, modify, reproduce, and publish your Likeness in connection with the above without notifying or compensating you other than as set forth in these Terms and Conditions. You also hereby waive any right that you have to inspect or approve the finished product or other copy that may be used in connection therewith or the use to which such finished product may be applied.
You understand that you will not receive any payment or compensation of any kind for use of the Feedback or Recordings except as specifically stated herein.
4. Risks
The probability and magnitude of harm or discomfort anticipated in the Research are not greater in and of themselves than those ordinarily using a computer or smartphone in daily life or during the performance of routine psychological examinations or tests. Any fatigue related to using a computer or smartphone device can be relieved by taking a break. The Research does not involve greater than minimal risk, and children and other protected populations will not be enrolled as participants. The nature of the questions may be perceived as personal. You are not obligated to answer all of the questions. If you feel uncomfortable in any way, you can stop any Research interview at any point.
5. Incentives
On an individual study basis, incentives to participants may be provided in exchange for completed and validated surveys and research exercises. Incentives will be earned once a response is verified as eligible, accurate, and honest.
The incentive earned for each completed and validated research exercise will vary based upon the nature and length of the survey. By registering and participating in surveys, you agree that Tetra Insights may contact you to conduct a brief validation of your eligibility and responses as necessary. Tetra Insights may require additional validation procedures to certify your eligibility and qualification as a research exercise participant.
All terms and conditions regarding your ability to receive incentives for participation in surveys and payments to you may be changed or modified at any time with or without notice at the sole discretion of Tetra Insights. Respondents are responsible for any taxes due as a result of payments they receive for participating in a research study. We are required by law to issue an IRS Form 1099 to any participant who is paid $600.00 or more annually for participation in research studies.
You hereby agree, when requested, to provide all information necessary for Tetra Insights to comply with tax reporting requirements.
Guaranteed incentives will be referenced at the beginning of any survey ore research exercise. These will be awarded after responses and contact information have been verified. All responses must be honest and accurate. Any information that is deemed misleading or untrue can result in a disqualification. Certain surveys or studies will have an incentive limit, and once reached, the study will be closed. It is possible a participant will inadvertently complete a study when the incentive is no longer valid. We will remedy such situations on a case-by-case basis.
Incentives may also include the inclusion in a drawing for a reward. In this case, once a research study is completed (determined at the discretion of Tetra Insights), all eligible participants will be entered for a random selection. This selection may be done digitally or physically within 90 days of the completion of the research study. For certain studies, the quality of responses or referrals to additional responses may increase the number of opportunities a participant has to win a drawing. These terms will be mentioned during the course of a research study.
6. Participant Privacy & Confidentiality
You understand and agree that your participation in the Research may require that you share personal information about yourself, including, without limitation, including information about your health. You understand that by participating in the Research, you are consenting to the use and disclosure of some of your personal information, including information about your health for uses described in these Terms and Conditions and as described in our Privacy Policy. The privacy of our Research participants and the confidentiality of the personal information they provide us are our top priority. Personal information will never be included with Research response information that we provide to our clients without the participant’s consent, and we will we never sell any of your personal information to any third party.
You agree to maintain as confidential (and accordingly will not share with any third parties), any information provided to you by or on behalf of Tetra Insights or our clients, or that you acquire or learn as a result of my participation in Research. You understand that if you breach such confidentiality, Tetra Insights will have the right to pursue any and all remedies available to it at law, or otherwise, against you. In furtherance of and without limiting the foregoing, you will not make any public statements of any kind about your participation in Research without the prior written consent of Tetra Insights.
7. Disqualification and Termination
Participants found engaging in any of the following activities may be disqualified from participating in Research and from being compensated: (i) tampering with, disrupting, or attempting to disrupt, or any unauthorized use, misuse or abuse of, any aspect of the Research; (ii) violating any applicable law; (iii) providing or maintaining incomplete or inaccurate contact information; (iv) attempting to defraud the any application, software, platform or system related to the Research, including through multiple entries for the same Research Project, false identification or email addresses, false registration, false impersonation, or any other means; (v) failing to provide complete and accurate information required for payment of incentives and/or tax reporting purposes; or (vi) any other breach or violation of these Terms and Conditions. Participants will not receive incentives for Research participation not completed and validated.
8. Voluntary Participation
You agree that your participation in Research is entirely voluntary and you may discontinue your participation at any time. Should you discontinue your participation, Tetra Insights will compensate you a prorated amount based on the length of time you participated. You warrant and represent that you have the full right and power to enter into this agreement and that this release does not in any way conflict with any existing contracts or commitments to any third party. Nothing herein will constitute any obligation of Tetra Insights to make any use of your Feedback or any Recordings made hereunder. You understand and agree that you are an independent contractor of Tetra Insights and that nothing herein will create an employment relationship with Tetra Insights.
9. Indemnity and Release
You agree to indemnify and hold Tetra Insights and its affiliates, subsidiaries, agents, directors, officers, employees, representatives, licensors (including third party service providers) and clients harmless from any claims, demands, losses, costs and expenses, including attorneys’ fees, made by any person arising out of your violation of these Terms and Conditions, the Privacy Policy, state or federal laws or regulations, or any other third party rights, including but not limited to infringement of any intellectual property right or violation of any proprietary or privacy right.
To the extent permitted by law, you agree not to sue and irrevocably, unconditionally, and entirely release and waive all claims that you may have against Tetra Insights and its affiliates, subsidiaries, agents, directors, officers, employees, representatives, licensors (including third party service providers) and clients for damages or losses that may arise from or relate to the Research, Recordings or any exercise of the rights granted in this agreement, including those damages or losses based on (a) any personal injury, including death, or property damage, or (b) any and all claims for damages for libel, slander, invasion of privacy, and any other claim arising from the use, display, disclosure, publication, or reproduction of the above described materials, including the Feedback and Recordings. . Your release and waiver of claims will apply whether or not such damages or losses were contributed to or caused by the fault of Tetra Insights.
These Terms and Conditions are subject to change at any time. Please be sure to check for updates prior to engaging in a new Research Project.
By participating in a Research Project, you acknowledge that you have read and understand these Terms and Conditions.
